機械関連の特許出願の拒絶理由通知の対応について

今回は、弊所の実績をスタッフ（K）からご紹介します。

1．相談の内容
　弊所は、クライアントからの指示により、機械に関する特許出願をしたが、拒絶理由通知を受けた。今回の拒絶理由通知は、新規性・進歩性の指摘は無かったが、サポート要件の指摘があった。サポート要件とは、請求項に係る発明が、発明の詳細な説明に記載した範囲を超えるものであってはならないという要件である。

2．解決策
　拒絶理由通知の内容を確認したところ、先行技術文献との関係で、請求項には、発明の課題を解決するために、構成要素Aの備えるべき必要条件を確認した。手続補正書において、請求項を補正し、この必要条件を追加した。この必要条件は、出願当初明細書中に記載された内容である。又、意見書において、この補正が、新規事項を追加する補正や、発明の特別な技術的特徴を変更する補正ではないことを、出願当初明細書中に記載された内容を引用するなどして説明した。これにより、必要条件が特定され、当業者が発明の課題を解決できることを認識できるものとなった。

3．結論
　特許権を取得するためには、いくつかの要件を満たす必要があり、その中に、サポート要件というものがある。サポート要件を満たすためには、先行技術文献の内容から、請求項に係る発明が、発明の詳細な説明に記載された範囲のものであり、当業者が発明の課題を解決できることを認識できるようにしなければならない。サポート要件等でお困りの方は、お気軽にご相談ください。
